On 9 September 2026, the European Commission presented its proposal for a European Innovation Act. Its aim is to facilitate financing and growth for innovative European companies and to accelerate the transition from research and new technologies to marketable products. The proposal now follows the EU legislative process.
Intellectual property as a source of finance
The Commission proposes a common European framework for valuing intellectual property. Patents, software, designs, know-how and other rights could then be used more readily in financing and company valuation.
The proposal also envisages a digital marketplace connecting buyers and sellers of intellectual property rights, supported by expert assistance for companies commercialising innovation.
New opportunities in research and development procurement
The proposal should make it easier for public buyers in different Member States to conduct joint research and development procurement. Clearer rules may create opportunities for innovative companies seeking their first major customers.
The package is accompanied by a separate proposal on regulatory sandboxes: controlled environments in which innovative products and business models can be tested under the supervision of competent authorities.
How can companies prepare?
Innovative companies can already clarify ownership of code, patents and other work results, review agreements with employees and external contributors, organise licences and prepare the documents needed to value their intellectual property.
